Eligibility criteria for Chapter 35 VA benefits To qualify for Chapter 35 VA benefits, both the Veteran or service member and their family members must meet specific requirements.

For the Veteran or service member, one of the following must be true:

* They are permanently and totally disabled due to a service-connected disability.

* They have died as a result of a service-connected disability.
* They died while serving in the line of duty.
* They are missing in action or were captured in the line of duty by a hostile force for more than 90 days.
* They were forcibly detained or interned in the line of duty by a foreign entity for more than 90 days.
* They are in a hospital or receiving outpatient treatment for a service-connected permanent and total disability, and are likely to be discharged for that disability.

For family members:

Children can be either married or unmarried. If they join the military, they can only use the benefit after leaving the service without a dishonorable discharge. Spouses can receive both DEA benefits and Dependency and Indemnity Compensation (DIC) simultaneously. However, divorce or remarriage (with some exceptions) can affect eligibility. Qualified family members may receive monthly payments to help with school costs or expenses during job training or an apprenticeship.
